Please read this Agreement carefully and be certain you understand its implications before signing. By signing, you give up important legal rights, including the right to sue. Your signature, electronic or otherwise, is taken as complete acceptance of this Agreement.
This Agreement applies to every activity, trip, event, program, rental, and service organized, hosted, or offered by Wilderness Union Inc. ("Wilderness Union") that I participate in for the duration of my membership or participation, including all associated transportation and equipment use, unless and until I sign a replacement agreement. This Agreement is binding on me and on my heirs, next of kin, executors, administrators, estate, and assigns.
I hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with the recreational activities in which I will engage, generally described as, but not limited to: hiking, backpacking, canoeing, kayaking, swimming and other water activities, camping, cycling, skiing, snowboarding, snowshoeing, climbing, skills training, and other indoor and outdoor activities, including the rental of equipment and transportation associated therewith.
Inherent hazards and risks include but are not limited to:
1. Risk of injury from the activity and equipment utilized is significant, including the potential for permanent disability and death.
2. Possible equipment failure and/or malfunction of my own or others' equipment.
3. Risks associated with outdoor environments, including exposure to the elements, excessive heat, excessive cold, hypothermia, illness, disease (including communicable diseases such as COVID-19 and other infectious illnesses), drowning, falls, impact of the body upon snow, ice, water, rock, or ground, and encountering natural or man-made objects.
4. My own negligence and/or the negligence of others, including but not limited to operator error and guide decision-making, including misjudging terrain, rapids, weather, trails, or route location.
5. Attack by or encounter with insects, ticks, reptiles, and/or wild or domestic animals, including animals moving in an unanticipated manner and causing injury and/or death.
6. Accidents or illness occurring in remote places where there are no immediately available medical facilities, and delays in rescue, evacuation, or medical care.
7. Vehicle accidents arising from transport to, from, or during each activity.
I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. I freely and voluntarily assume all such risks, both known and unknown.
I understand that any member-led activities and any activities not listed on www.wildernessunion.com are unsanctioned, and Wilderness Union assumes no responsibility for such events.
Alcohol and recreational drugs, including cannabis in any form, are strictly forbidden on Wilderness Union trips. Should I choose to consume alcohol or any recreational drug before, during, or in connection with a trip, I do so entirely at my own risk, and Wilderness Union assumes no responsibility for any consequences that may result. I understand that participating in any activity while impaired is grounds for immediate removal from the trip without refund.
Carpooling arrangements are not the responsibility of Wilderness Union. Wilderness Union takes no responsibility for any incidents, accidents, or issues that may arise during carpooling to or from activities.
I understand that, where dogs are permitted, activities may be dangerous for such animals and it is my responsibility alone to ensure the safety of my dog. I further agree that I am solely responsible and liable for the behaviour of any dog I bring, and I agree to indemnify and hold harmless Wilderness Union from any claim, injury, damage, or loss caused by my dog to any person, animal, or property.
I represent that I am in adequate physical condition to participate in the activities I have signed up for, and that I have honestly assessed my own ability to meet their physical demands. I agree to disclose to Wilderness Union, in advance of any trip, any medical conditions, allergies, injuries, or medications that could reasonably affect my safety or the safety of others during the activity, including but not limited to heart conditions, asthma, diabetes, seizure disorders, severe allergies, pregnancy, and recent surgeries. I agree to provide and maintain an accurate emergency contact.
I understand that Wilderness Union is not a medical provider, that some activities take place in remote areas without immediate access to medical facilities, and that the decision to participate is mine alone. In the event of an injury, illness, or medical emergency in which I am unable to give consent, I authorize Wilderness Union, its staff, contractors, and guides to arrange or consent to such emergency medical treatment, transportation, or evacuation as they reasonably believe necessary, at my own expense.
I consent to Wilderness Union collecting, using, and retaining the personal information I provide, including my legal name, date of birth, contact details, emergency contact, and health information, for the purposes of trip planning, safety, insurance, emergency response, and legal compliance, and to disclosing that information to guides, contractors, insurers, medical providers, and emergency services where reasonably necessary for those purposes. Wilderness Union will handle my personal information in accordance with applicable privacy law.
I agree to follow the reasonable instructions of Wilderness Union staff, guides, and trip leaders at all times during any activity, particularly with respect to safety, route choice, weather, and group decisions. I understand that Wilderness Union reserves the right, at its sole discretion, to remove me from a trip or activity, refuse my participation in future activities, and cancel or suspend my membership, in each case without refund of any fees paid, if I refuse to follow safety instructions, am impaired by alcohol or drugs, behave in a manner that endangers myself or others, harass or mistreat other participants or staff, or otherwise act in a way that is incompatible with the safety and culture of the Wilderness Union community.
I agree to remain with the group and under the supervision of Wilderness Union staff, guides, or trip leaders for the duration of any activity unless I inform a leader that I am leaving. I understand that if I choose to leave an activity before it is completed, separate from the group, or depart from the planned route for any reason, whether or not I notify a leader, I do so entirely at my own risk. From the moment I leave or separate, Wilderness Union has no responsibility for my safety, supervision, navigation, transportation, or wellbeing, and I release the Releasees from any and all liability, claims, or causes of action arising from or following my departure or separation, including injury, illness, becoming lost, exposure, or death. I understand that Wilderness Union has no obligation to search for me, delay or alter the activity, or arrange my return transportation, and that any search, rescue, or evacuation costs incurred as a result of my departure or separation are my sole responsibility.
By signing this Agreement and participating in any Wilderness Union activity, I represent and warrant that all personal information I have provided to Wilderness Union, including but not limited to my legal name and date of birth, is true, accurate, and complete. I understand that Wilderness Union relies on this information for safety planning, insurance, emergency response, and legal compliance, and that any misrepresentation may compromise the safety of myself and others. Should Wilderness Union determine, at its sole discretion, that I have provided false or misleading information regarding my age, name, or any other material personal detail, Wilderness Union reserves the right to immediately cancel my membership and to refuse my participation in any trip or activity, without notice and without any obligation to refund membership fees, trip fees, deposits, or any other amounts paid.
In consideration of being permitted to participate in the activities described above and related activities, I agree as follows:
1. RELEASE AND WAIVER. I HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE Wilderness Union Inc. and its officers, directors, employees, contractors, guides, representatives, agents, volunteers, insurers, and its parent, subsidiary, and affiliated entities (collectively, the "Releasees") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION WHATSOEVER, whether known or unknown, arising out of or related to any injury, disability, death, or loss or damage to person or property that I may suffer in connection with my participation in the activities, or transportation to, from, or during the activities, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, including negligence in the operation of premises, to the fullest extent permitted by law. This release includes any claims that my estate, heirs, survivors, executors, administrators, or assigns may have.
2. OCCUPIERS' LIABILITY. Without limiting the foregoing, this release extends to any liability of the Releasees as occupiers of premises under the Occupiers' Liability Act (Ontario), including any duty of care owed under that Act.
3. INDEMNITY. I agree to indemnify, defend, and hold harmless the Releasees from any claim, liability, loss, damage, cost, or expense (including reasonable legal fees) arising from my participation in the activities, my breach of this Agreement, my conduct, or the conduct of any dog or minor in my care, including claims brought by third parties.
4. ASSUMPTION OF RISK. I acknowledge that this is a full assumption of risk. I am participating freely and voluntarily, with full knowledge of the risks involved.
I hereby grant Wilderness Union Inc., its officers, directors, employees, contractors, vendors, affiliates, and agents, and its assigns, licensees, and successors in interest, the irrevocable, perpetual, worldwide, royalty-free right to photograph, film, and record me, and to use my name (or any fictional name), image, voice, picture, portrait, photograph, and likeness ("Likeness") in all forms, in all media now known or later developed, and in all manners, without restriction as to changes or alterations (including blurring, distortion, alteration, optical illusion, use in composite form, or derivative works, whether intentional or otherwise), in connection with Wilderness Union's business, products, and services, including but not limited to advertising, marketing, publication, and any other lawful purpose. I waive any right to inspect, modify, or approve any intermediary or finished version of any material using my Likeness, and I waive any right to compensation. To the fullest extent permitted by law, I waive any moral rights I may have in any such material.
If I upload, submit, or otherwise provide photographs, videos, or other content to Wilderness Union, including to trip albums, community platforms, or any Wilderness Union system ("Uploaded Content"), I agree that:
1. LICENSE. I grant Wilderness Union Inc. and its assigns, licensees, and successors in interest a non-exclusive, irrevocable, perpetual, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, distribute, publicly display, create derivative works from, and otherwise exploit the Uploaded Content, in whole or in part, in any media now known or later developed, in connection with Wilderness Union's business, products, and services, including but not limited to advertising, marketing, publication, and commercial use, without notice, attribution, or compensation to me.
2. OWNERSHIP AND CONSENT. I represent and warrant that I own or have all necessary rights in the Uploaded Content, and that where the Uploaded Content depicts any identifiable person, I have that person's consent to upload it and to grant the license above.
3. MORAL RIGHTS. To the fullest extent permitted by law, I waive all moral rights in the Uploaded Content in favour of Wilderness Union and its licensees.
4. NO OBLIGATION. Wilderness Union has no obligation to use, display, or retain any Uploaded Content, and may remove any Uploaded Content at its sole discretion.
By entering into this Agreement, I am not relying on any oral or written representation or statement made by the Releasees other than what is set forth in this Agreement. This Agreement shall be binding to the fullest extent permitted by law. If any provision of this Agreement is found to be unenforceable, that provision shall be modified only to the extent necessary to make it enforceable, and the remaining terms shall continue in full force and effect.
This Agreement is governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, and the courts of Ontario shall have exclusive jurisdiction over any dispute arising out of or in connection with this Agreement. I agree that signing this Agreement electronically, including by checking a box, typing my name, clicking an acceptance button, or otherwise indicating my consent through Wilderness Union's online sign-up or booking systems, constitutes a valid and binding signature with the same legal effect as a handwritten signature.
I HAVE READ THIS RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT, I FULLY UNDERSTAND ITS TERMS, AND I UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, BY SIGNING. I DO SO FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. I REPRESENT THAT I AM AT LEAST 18 YEARS OF AGE AND LEGALLY COMPETENT TO EXECUTE THIS AGREEMENT, AND THAT ALL PERSONAL INFORMATION I HAVE PROVIDED TO WILDERNESS UNION, INCLUDING MY LEGAL NAME AND DATE OF BIRTH, IS TRUTHFUL AND ACCURATE, WHICH SHALL BE A BINDING COMMITMENT.
