WILDERNESS UNION DIGITAL GIFT CARD TERMS AND CONDITIONS

1. DEFINITIONS
"Gift Card" means the digital gift card issued by Wilderness Union that can be redeemed for purchases of goods and/or services offered by Wilderness Union.
"Wilderness Union", "we", "us", or "our" refers to Wilderness Union and its authorized representatives.
"You" or "Cardholder" refers to the purchaser or recipient of the Gift Card.
2. GIFT CARD PURCHASE AND ISSUANCE
2.1. Digital Gift Cards are available for purchase through our website.
2.2. Payment for Gift Cards must be made in Canadian dollars (CAD) using accepted payment methods.
2.4. Upon successful purchase, you will receive a digital Gift Card via email containing a unique code.
2.5. Gift Cards are issued and managed by Wilderness Union.
3. GIFT CARD USE AND REDEMPTION
3.1. Gift Cards may be redeemed for the purchase of eligible products and services offered by Wilderness Union.
3.2. To redeem a Gift Card, enter the unique Gift Card code at checkout on our website.
3.3. Gift Cards cannot be redeemed for cash except as required by applicable law.
3.4. Due to system limitations, only one (1) Gift Card may be used per transaction. If the Gift Card balance does not cover the full purchase amount, the remaining balance must be paid using another accepted payment method.
3.5. Additional Gift Cards may be used on separate transactions.
3.6. If the purchase amount exceeds the Gift Card balance, the remaining balance must be paid using another accepted payment method.
3.7. Any unused balance will remain on the Gift Card for future use.
3.8. Gift Cards cannot be used to purchase other Gift Cards.
4. EXPIRY AND FEES
4.1. No Expiry Date: In accordance with Canadian consumer protection legislation, this Gift Card has no expiry date.
4.2. No Fees: We do not charge dormancy fees, inactivity fees, service fees, or any other fees that reduce the Gift Card balance.
5. BALANCE INQUIRIES
5.1. You may check your Gift Card balance at any time by:
Visiting our website and entering your Gift Card code
Contacting our customer service team
5.2. It is your responsibility to know your available Gift Card balance before making a purchase.
6. LOST, STOLEN, OR DAMAGED GIFT CARDS
6.1. Gift Cards are treated like cash. Wilderness Union is not responsible for lost, stolen, damaged, or unauthorized use of Gift Cards.
6.2. We may be able to replace a lost or stolen Gift Card if you provide proof of purchase and the unique Gift Card code, at our sole discretion.
6.3. To protect your Gift Card, treat it like cash and keep your unique code confidential.
7. RESTRICTIONS AND LIMITATIONS
7.1. Gift Cards are valid only for purchases from Wilderness Union.
7.2. Only one (1) Gift Card may be used per transaction due to system limitations. Additional Gift Cards may be used on separate transactions.
7.3. Gift Cards cannot be:
Redeemed for cash (except as required by law)
Returned or exchanged for cash or credit
Used to purchase other gift cards
Reloaded or topped up with additional funds
Transferred to another account or person after activation (though they may be gifted prior to first use)
7.4. Wilderness Union reserves the right to refuse redemption of any Gift Card that we believe has been obtained, used, or is being used fraudulently or unlawfully.
7.5 Gift cards cannot be combined with any credits on an account.
7.6 In order to use a gift card to purchase a member only event, the user must be an approved, active member of Wilderness Union.
8. RETURNS AND REFUNDS
8.1. Products purchased with a Gift Card are subject to Wilderness Union's standard refund policy.
8.2. If you purchased an adventure or merchandise with a Gift Card, the refund will be issued as a credit to the original Gift Card or a new Gift Card, at our discretion.
8.3. Gift Card purchases are final and non-refundable, except as required by applicable law.
9. PROVINCIAL CONSUMER PROTECTION LAWS
9.1. These Terms and Conditions are subject to applicable provincial and federal consumer protection legislation, including but not limited to:
Consumer Protection Act, 2002 (Ontario)
Consumer Protection Act (British Columbia)
Consumer Protection Act (Alberta)
Consumer Protection Act (Quebec)
And similar legislation in other Canadian provinces and territories
9.2. Where provincial laws impose additional protections or restrictions, those laws shall apply and take precedence over these terms.
10. LIMITATION OF LIABILITY
10.1. Wilderness Union's liability is limited to the face value of the Gift Card.
10.2. We are not responsible for:
Unauthorized use of Gift Cards
Lost, stolen, or damaged Gift Cards
Technical issues that prevent Gift Card redemption
Any indirect, incidental, or consequential damages
10.3. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. INTELLECTUAL PROPERTY
11.1. All Gift Card designs, logos, and related intellectual property remain the exclusive property of Wilderness Union.
11.2. You may not reproduce, modify, or distribute Gift Card designs or codes without our express written permission.
12. PRIVACY
12.1. Personal information collected in connection with Gift Card purchases and redemptions is handled in accordance with our Privacy Policy and applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
12.2. We collect and use personal information only for purposes related to Gift Card transactions, customer service, and fraud prevention.
13. FRAUD AND MISUSE
13.1. We reserve the right to investigate and take appropriate action against fraudulent or unauthorized use of Gift Cards, including but not limited to:
Canceling Gift Cards
Refusing redemption
Pursuing legal remedies
Reporting to law enforcement
13.2. You agree not to use Gift Cards for any unlawful purpose or in violation of these terms.
14. MODIFICATIONS TO TERMS
14.1. Wilderness Union reserves the right to modify these Terms and Conditions at any time with reasonable notice.
14.2. Modifications will be effective upon posting on our website.
14.3. Your continued use of Gift Cards after modifications constitute acceptance of the updated terms.
14.4. Material changes that negatively impact existing Gift Card holders will not apply retroactively to Gift Cards purchased before the change.
15. BUSINESS CHANGES
15.1. If Wilderness Union is sold, merged, or undergoes a change in ownership, Gift Cards will remain valid and honored by the successor entity for a reasonable period.
15.2. In the event of business closure or bankruptcy, Gift Card holders will be treated in accordance with applicable insolvency and consumer protection laws.

17. GOVERNING LAW AND DISPUTE RESOLUTION
17.1. These Terms and Conditions are governed by the laws of the province in which Wilderness Union is registered and the federal laws of Canada applicable therein.
17.2. Any disputes arising from these terms or Gift Card use shall be resolved in the courts of the province where Wilderness Union is registered.
17.3. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18. SEVERABILITY
18.1. If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.
19. ENTIRE AGREEMENT
19.1. These Terms and Conditions constitute the entire agreement between you and Wilderness Union regarding Gift Cards and supersede all prior agreements and understandings.
20. LANGUAGE
20.1. These Terms and Conditions are provided in English. If provided in both English and French, and there is any conflict between the versions, the English version shall prevail except in Quebec where French shall prevail.By purchasing or using a Wilderness Union Gift Card, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
