Wilderness Union Inc - Waiver

Please read and be certain you understand the implications of this waiver. Your signing is taken as complete acceptance of this waiver.

I hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with the recreational activity generally described as, but not limited to, hiking, canoeing, kayaking, camping, cycling, skiing, snowboarding, snowshoeing, climbing, and other indoor and outdoor activities, including the rental of equipment and transportation associated therewith in which I will engage.

Inherent hazards and risks include but are not limited to:

  1. Risk of injury from the activity and equipment utilized is significant, including the potential for permanent disability and death.
  2. Possible equipment failure and/or malfunction of my own or others' equipment.
  3. This activity or portions of it takes place outdoors and therefore includes risks associated with exposure to elements, excessive heat, excessive cold, hypothermia, illness, disease, drowning, impact of the body upon the snow, encountering objects either natural or man-made, exposure to animals with the attendant risk of kicking, biting, shying away, running off, or otherwise moving in an unanticipated manner causing injury and/or death.
  4. My own negligence and/or the negligence of others, including but not limited to operator error and guide decision-making, including misjudging terrain, rapids, weather, trails, or route location.
  5. Attack by or encounter with insects, reptiles, and/or animals.
  6. Accidents or illness occurring in remote places where there are no immediately available medical facilities.
  7. Vehicle accidents arising from transport to, from, or during each activity.

Alcohol, Drugs, and Carpooling:

  • Alcohol and recreational drugs, including cannabis in any form, are strictly forbidden on Wilderness Union trips. Should I choose to consume alcohol or any recreational drug before, during, or in connection with a trip, I do so entirely at my own risk, and Wilderness Union assumes no responsibility for any consequences that may result. I understand that participating in any activity while impaired is grounds for immediate removal from the trip without refund.
  • Carpooling arrangements are not the responsibility of Wilderness Union. We take no responsibility for any incidents, accidents, or issues that may arise during carpooling to or from the activities.

I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. I understand that, while dogs are permitted, activities may be dangerous for such animals and it is my responsibility alone to ensure the safety of my dog. Furthermore, I understand that any member-led activities and those not listed on www.wildernessunion.com are unsanctioned, and Wilderness Union assumes no responsibility for such events.

Fitness, Health, and Medical Treatment:

I represent that I am in adequate physical condition to participate in the activities I have signed up for, and that I have honestly assessed my own ability to meet their physical demands. I agree to disclose to Wilderness Union, in advance of any trip, any medical conditions, allergies, injuries, or medications that could reasonably affect my safety or the safety of others during the activity, including but not limited to heart conditions, asthma, diabetes, seizure disorders, severe allergies, pregnancy, and recent surgeries. I understand that Wilderness Union is not a medical provider, that some activities take place in remote areas without immediate access to medical facilities, and that the decision to participate is mine alone. In the event of an injury, illness, or medical emergency in which I am unable to give consent, I authorize Wilderness Union, its staff, contractors, and guides to arrange or consent to such emergency medical treatment, transportation, or evacuation as they reasonably believe necessary, at my own expense.

Participant Conduct and Right of Removal:

I agree to follow the reasonable instructions of Wilderness Union staff, guides, and trip leaders at all times during any activity, particularly with respect to safety, route choice, weather, and group decisions. I understand that Wilderness Union reserves the right, at its sole discretion, to remove me from a trip or activity, refuse my participation in future activities, and cancel or suspend my membership, in each case without refund of any fees paid, if I refuse to follow safety instructions, am impaired by alcohol or drugs, behave in a manner that endangers myself or others, harass or mistreat other participants or staff, or otherwise act in a way that is incompatible with the safety and culture of the Wilderness Union community.

Accuracy of Personal Information:

By signing this waiver and participating in any Wilderness Union activity, I represent and warrant that all personal information I have provided to Wilderness Union, including but not limited to my legal name and date of birth, is true, accurate, and complete. I understand that Wilderness Union relies on this information for safety planning, insurance, emergency response, and legal compliance, and that any misrepresentation may compromise the safety of myself and others. Should Wilderness Union determine, at its sole discretion, that I have provided false or misleading information regarding my age, name, or any other material personal detail, Wilderness Union reserves the right to immediately cancel my membership and to refuse my participation on any trip or activity, without notice and without any obligation to refund membership fees, trip fees, deposits, or any other amounts paid.

Release of Liability, Waiver of Claims, Indemnity Agreement, and Photo Release

In consideration for being permitted to participate in the activity(ies) described above and related activities, I hereby agree, acknowledge, and appreciate that:

  1. I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, the following named entity, (herein referred to as "releasee"): Wilderness Union Inc.
  2. To release the releasee, its officers, directors, employees, contractors, representatives, agents, and volunteers, vessels, and its parent and subsidiary affiliates from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities or during transportation to these activities whether caused by active or passive negligence of the releasee or otherwise. By executing this document, I agree to hold the releasee harmless and indemnify it in conjunction with any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the above activities.
  3. I hereby give Wilderness Union Inc., its officers, directors, employees, contractors, vendors, affiliates, and agents, and its assigns, licensees, successors in interest, legal representatives, and heirs the irrevocable right to use and make photographs (still, film, tape, or otherwise), to use and record with a video or audio recording device, my name (or any fictional name), picture, portrait, photograph, and/or likeness in all forms and in all media and in all manners ("Likeness"), without any restriction as to changes or alterations (including but not limited to blurring, distortion, alteration, optical illusion, or use in composite form, or derivative works of my Likeness made in any medium, whether intentional or otherwise) in connection with the activity(ies) through Wilderness Union Inc's business, products and/or services, including but not limited to advertising, publication, or any other lawful purposes. I waive any right to inspect, modify, or approve any intermediary version(s) or finished version(s) of the results of the use of my likeness ("Results"). I waive any right to further compensation.
  4. By entering into this Agreement, I am not relying on any oral or written representation or statements made by the releasee, other than what is set forth in this Agreement. This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforceable.

Governing Law and Electronic Acceptance:

This Agreement is governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, and the courts of Ontario shall have exclusive jurisdiction over any dispute arising out of or in connection with this Agreement. I agree that signing this Agreement electronically, including by checking a box, typing my name, clicking an acceptance button, or otherwise indicating my consent through Wilderness Union's online sign-up or booking systems, constitutes a valid and binding signature with the same legal effect as a handwritten signature.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING BELOW, AND I DO SO FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. I REPRESENT THAT I AM OVER 18 AND LEGALLY COMPETENT TO EXECUTE THIS AGREEMENT, AND THAT ALL PERSONAL INFORMATION I HAVE PROVIDED TO WILDERNESS UNION, INCLUDING MY LEGAL NAME AND DATE OF BIRTH, IS TRUTHFUL AND ACCURATE, WHICH SHALL BE A BINDING COMMITMENT.
